Black Hawk County prosecutor pleads to OWI


WATERLOO (KWWL) -- An assistant Black Hawk County attorney has pleaded guilty to a drunken driving charge even though his blood alcohol level was below the legal limit.

Court records show James Katcher, 46, of Cedar Falls, pleaded guilty to operating while intoxicated stemming from a September stop by an Iowa state trooper.

Matcher received a deferred judgment last week. His license was revoked for 60 days, and he was ordered to pay a $1,250 civil penalty.

Katcher says a breath test showed that his blood alcohol content was .078, which is below the legal limit of .08. However, he says that in Iowa a person can still be guilty of OWI if they drive under the influence of alcohol.

County Attorney Tom Ferguson says Katcher may be subject to disciplinary action.
