Lawsuit filed over Marshalltown power plant


DES MOINES (KWWL) - A lawsuit has been filed over the Iowa Utility Board's approval of Alliant Energy's plan to build a coal-burning power plant in Marshalltown.

The lawsuit filed Friday in Polk County District Court claims the utility board's May 2008 decision was not supported substantial evidence.

The lawsuit, filed by Community Energy Solutions, The Iowa Physicians for Social Responsibility and the Iowa Renewable Energy Association, attacks the board's decision requiring Alliant to build 1,600 megawatts of wind energy and obtain 10 percent of the plant's energy by burning biomass.

The groups claim they weren't given an opportunity address the merits of the energy mix.

Utilities Board spokesman Rob Hillesland says the board hasn't seen the lawsuit and could not comment.
