Iowa prosecutors want change in murder law

DES MOINES (KWWL) - Iowa prosecutors have asked lawmakers to re-establish a first-degree murder crime in cases when a separate felony results in death.

The request stems from a 2008 Iowa Supreme Court decision overturning the first-degree murder conviction of a central Iowa farmer who killed his neighbor. The ruling changed a legal precedent that allowed prosecutors to allege first-degree murder in cases where someone commits an act intended to cause serious injury resulting in death.

Polk County Attorney John Sarcone says common sense and legal fairness requires that Legislature make it clear that such situations constitute first-degree murder.

Mark Smith of the state public defender's office says the bill that prosecutors have proposed is too broad.
