Rubashkin wants charges dismissed

CEDAR RAPIDS (KWWL) -- The former Agriprocessors CEO, Sholom Rubashkin, wants a judge to dismiss nearly 100 counts against him.

If the judge will not dismiss those charges, Rubashkin wants to be charged separately for different charges.

In motions filed Friday in U.S. District Court in Cedar Rapids, Rubashkin argued the grand jury was biased by improper testimony and conduct.

Rubashkin's attorney wants the immigration and bank fraud charges his client faces, as well as a charge of violating an Agriculture Department order regarding the sale of cattle, to be handled through three separate trials.

The indictment against Rubashkin follows an immigration raid in May of 2008 that resulted in 389 arrests.
