Fired Dubuque officer gets to keep job

DES MOINES (AP)-- A fired Dubuque police office accused of making a sexually explicit telephone call to a female officer will keep his job after all.

The decision comes following an Iowa Court of Appeals decision.

Officer Kurt Rosenthal was accused of placing several calls to the female officer's cell phone while out drinking with other off-duty officers in October 2007. He also was accused of driving around the city that evening while intoxicated.

The following month, Rosenthal was fired and he challenged the termination.

The Dubuque Civil Service Commission reduced his punishment to a 30-day unpaid suspension. The city appealed and the Dubuque County District Court upheld the suspension, which also was appealed.

In its ruling, the appeals court says Rosenthal's actions constituted misconduct, but that it was an isolated incident.
