Rubashkin granted new bail hearing

IOWA CITY (KWWL) -- A judge has granted the former Agriprocessors CEO a new bail hearing.

Chief U.S. District Court judge Linda Reade says in an order handed down last week that she will hold an evidentiary hearing on Thursday to decide whether former Agriprocessors CEO Sholom Rubashkin should await his trial in jail.

Reade says the hearing will allow written evidence from attorneys and testimony from witnesses called by either side. The ruling is a small victory for Rubashkin's defense team, which had been arguing in a series of motions with prosecutors that Rubashkin is not a flight risk. They say the invocation of a 58-year-old Israeli emigration law improperly clouded other evidence against Rubashkin.

Some Jewish groups have gathered to protest Rubashkin being held, and some have even raised money to pay for a potential bail.

Just last week Rubashkin was named in another 99-count federal indictment. Charges against Rubashkin and others have followed a May 12 immigration raid at the plant that resulted in the arrest of 389 people.
