Judge considers case of bar violating smoking ban

ANKENY, Iowa (AP) - A lawyer for a West Burlington bar is claiming that Iowa's smoking ban violates the state's constitution.

The lawyer for Otis Campbell's Bar and Grill told an administrative law judge Friday that the smoking ban violates Iowa's constitution because it unfairly allows smoking in some areas - mainly casinos - while banning it in other areas. He says the case was in the wrong jurisdiction and should be heard before a judicial magistrate.

The hearing in Ankeny was being held as part of a state effort to suspend or revoke the bar's liquor license after repeated violations of Iowa's smoking ban.

Officials filed a complaint last month alleging the "open and continuing failure" of the bar to comply with the ban.

A decision is expected in 30 days.
