PALO (KWWL) -

UPDATE: Deputies in Linn County say a Dodge Grand Caravan was hit by a train in Palo on Monday after failing to yield for the train.

The driver is in jail tonight, while a passenger in the car was taken to the hospital, according to the Linn County Sheriff's Office. They say 37-year-old Cedar Rapids man Terrance Wright was behind the wheel of the car when it was hit by a train in the crossing along Vinton Street near Shellsburg Road around 6:29 p.m. on Monday. The car was hit by a southbound train and went into the west ditch. Wright apparently refused medical attention at the scene but was charged by deputies for Driving While License Under Suspension and Failure to Obey a Traffic Control Device.

Wright's passenger, 57-year-old Shellsburg man Brett Opperman, was taken to a nearby hospital for injuries that are not expected to be life-threatening, according to deputies.

The Linn County Sheriff's Office is continuing to investigate the accident, and was assisted at the scene by Linn County Sheriff’s Rescue, Hiawatha Ambulance and the Palo Fire Department.
