Iowa City man faces assault charge after allegedly spitting on a police officer

An Iowa City man is being charged with Assault on Peace Officers and Others after he allegedly spit on a police officer. 

University Heights police say they saw 49-year-old Gary Duffel walking in traffic in the 1000 block of Melrose Avenue Wednesday. 

According to the criminal complaint Duffel told police his tooth hurt and he was trying to get to the hospital. 

Officers say they could smell alcohol on his breath so they tested him with a breathalyzer and determined he had a BrAC of .208%.

Police arrested Duffel and took him to the University of Iowa Hospital to get his tooth checked out. 

The criminal complaint says Duffel became angry in the emergency room and began spitting towards the doctor and on the floor. 

Police say when they tried to escort Duffel away from the doctor and out of the emergency room he spit on a police officers arm. 

According to the complaint, when officers tried to put him into the police car he kicked it and spit on it, officers ended up putting a spit hold on Duffel and taking him to jail. 

In addition to being charged with Assault on Peace Officers and Others he is facing charges of Interference with Official Acts, Disorderly Conduct-Loud and Raucous Noise and Public Intoxication. 

Duffel is being held at the Johnson County Jail on a $5,000 bond.
