Soules files motion to dismiss charges against him

BUCHANAN COUNTY (KWWL) -

Chris Soules, and his attorneys, are asking a Buchanan County judge to dismiss charges against him, claiming the law he's accused of violating is unconstitutional. 

The 35-year-old former reality star is accused of crashing into the back of a tractor earlier this year, and then allegedly leaving the scene. 68-year-old Kenny Mosher of Aurora died after being hit in a crash along Slater Avenue on April 24.

In a filing this week in Buchanan County District Court, Soules' attorneys challenged the validity of the statue he's accused of violating. 

The law reads: 

 “After leaving the scene of the accident, a surviving driver . . . shall immediately return to the scene of the accident or inform the law enforcement authorities where the surviving driver can be located.” 

Soules' attorneys argue that he fulfilled the requirement by calling 911, saying that the requirement that someone 'return to the scene' violates the 5th Amendment of the United States Constitution.

The court has set a hearing on the Motion to Dismiss for October 10 at 1:30 p.m.
