An Indiana mother hopes to use her state's Religious Freedom Restoration Act as defense, in what prosecutors are calling child abuse.
Kin Park Thaing faces charges, accused of beating her 7-year-old son with a coat hanger.
The boy's teacher discovered his injures in February; he had 36 painful welts and bruises on his arm, back and neck.
Thaing's attorney says it was part of her religious freedom to discipline her son.
In court, her attorney asked for the case to be dismissed, citing a bible verse which reads "Do not withhold discipline from a child: if you strike him with a rod, he will not die. If you strike him with the rod, you will save his soul from Sheol."
The judge denied the dismissal.
Investigators say Thaing admitted to beating him, saying she believed he was going to hurt his younger sister.
