Teen won't be tried in Des Moines slaying; witnesses balking

DES MOINES, Iowa (AP) - Prosecutors say they can't prosecute a 15-year-old charged in a Des Moines gang slaying, because witnesses aren't cooperating.

Charges against Marvin Holmes were dismissed last week but may be refiled. He was charged with first-degree murder in the fatal shooting of 17-year-old Kendall Foster on April 27. A judge had ruled that Holmes would be tried in adult court.

Polk County Attorney John Sarcone says that without the help of three witnesses who were friends of Foster, there is no case.

Police say Holmes' residence was targeted in drive-by shootings Sunday and early Monday morning. No injuries and no arrests have been reported.
