Frederiksen tries to appeal murder conviction

Casey Frederiksen is trying to appeal his murder and sex abuse charges against Evelyn Miller.
Evelyn Miller, 5, was murdered in 2005, and Frederiksen was dating her mother at the time.
In 2014, he was accused of raping and murder young Evelyn, but he's trying to appeal the case.

Even though the FBI was able to find several images and video of child pornography on his computer, Frederiksen's attorney say that isn't enough evidence to convict him of sex abuse or murder.
However, the state argues that the child pornography found on his computer is similar sex abuse to what Frederiksen is accused of doing to Evelyn Miller.
The three judges will make a written decision, whether to approve a new trial for Frederiksen at a later date.
Court officials say it could take weeks or even months for them to reach a decision.
