Eddie Chest resentenced for third time

It's a new sentencing hearing for 77-year old Eddie Chest -- the third one.

Chest was previously convicted of first-degree armed robbery and attempted murder for  shooting Dubuque Police Lt. Scott Baxter, which took place at Knickers Saloon in December of 2009.

However, the Iowa Court of Appeals threw out his 25 year sentence citing his plea deal wasn't presented properly and his attorney agreed.

"By this third time, this third sentencing...so tainted by what the Appellate Court has interpreted as the county attorney's failure to enthusiastically endorse a plea bargain in this matter," said Bill Lansing.

The defense argued Chest only accepted a plea deal because the two 25 year sentences were supposed to be served at the same time.

But the prosecution argued they should be served back-to-back.  "We  are making this recommendation to the court today in good faith, the state understands that when we make a negotiation with the defense it is not with the court," said Dubuque Assistant Attorney Chris Corken.

Ultimately, the judge ruled that Chest is guilty taking into account his extensive criminal history.

Chest has been sentenced to serve two 25 year sentences consecutively, totaling 50 years.

"You were on parole at the time you committed this offense.  For that reason the court finds the consecutive offenses are appropriate," said Judge Joel Dalrymple.

The judge told Chest he can appeal his sentence within 30 days.

Chest told the judge he won't miss the deadline.
