Waterloo man loses appeal in officer shooting case

The Iowa Court of Appeals has upheld the conviction of a man who shot at a Waterloo police officer in 2009.

Darnell Demery was sentenced to 30 years in prison after being convicted of attempted murder, assault on a peace officer and related charges back in 2010.

Authorities say police approached Demery in July 2009 after a hit-and-run crash.

Demery fled, then turned and fired at an officer.

The officer was not hit, but returned fire, hitting Demery in the arm.

Demery wanted to have the conviction thrown out, because he claimed his attorney was ineffective.

He claims his attorney didn't perform deposition interviews before the trial.

The Iowa Court of Appeals rejected his claim.

They claimed Demery could not show how the depositions would have changed the court's decision during the trial.
