A Waterloo man could be facing his third trial for a robbery charge after a second jury couldn't make a decision.

A mistrial was declared Friday for the Jess Matthews' case.

A different jury also couldn't reach a decision back in July.

Prosecutors say Mathews, 20, conspired with four other people to burglarize Byron Supermarket last October, but the burglary plan fell apart when one of the store's workers discovered the back door had been propped open.

Assistant County Attorney James Katcher says Mathews used a BB gun to threaten the store owner as she was leaving with the nightly deposit.

Defense attorney James Moriarty says Mathews wasn't involved in the robbery and is being blamed by the others.
