Additional court appearance set for Durango man charged in fatal crash

GALENA, Ill. (TH Media) -

A Durango, Iowa, man charged with reckless homicide and driving under the influence after fatal crash on the Julien Dubuque Bridge made a court appearance today during a brief status hearing.

Cody J. Berry, 19, appeared in Jo Daviess County, Ill. Circuit Court for the hearing. He previously pleaded not guilty to two counts of reckless homicide, two counts of aggravated driving under the influence of alcohol in an accident causing bodily harm and two counts of aggravated driving under the influence causing death.

Authorities said Berry was driving across the Julien Dubuque Bridge on Nov. 17 and crossed the centerline, striking a semi tractor-trailer head-on. Berry’s passenger, Gavin Gremmel, 18, died of his injuries. Berry and semi driver, Neil T. Erb, of Roscoe, Ill., were injured.

Shortly after convening court, Judge William Kelly ordered an additional status hearing Sept. 10 based on an agreement from defense attorney Terry Kurt and State’s Attorney John Hay.
