Landlord charged with assaulting tenant

OTTUMWA (KWWL) -

A confrontation between an Iowa landlord and his tenant is caught on tape.

The landlord, from Ottumwa, has a weapons permit and believed he was being threatened when he pulled a gun on a man in March.

He has now been charged with assault with a dangerous weapon.

Police say a permit holder can only pull out their gun if they believe they or someone else is in imminent danger and only if they don't have a chance to run away.

"He actually took two or three steps forward and engaged the individual and therefore it's kind of a different circumstance," said Lt. Jason Bell from the Ottumwa Police Department.

"I was defending myself and defending my honor. I went to Vietnam and I'm not going to get stabbed again," said Johnie Eakins, who's now facing charges.
