Will child porn be evidence for Evelyn Miller murder trial?

The man accused of sexually abusing and killing five-year-old Evelyn Miller doesn't want jurors to know about his admitted child-porn collection.

Casey Frederiksen is charged with First Degree Murder and First Degree Sexual Abuse. Police believe he molested her and then killed her to hide the evidence. Her body was found in the Cedar River in 2005. An autopsy found stab wounds in her necks and shoulders, and what investigators call 'sexual injuries.'

While investigating her disappearance, authorities found a hard drive containing thousands of child pornography images and videos. Frederiksen is currently serving a federal prison for possession that child porn, as well as drug charges. He is scheduled for release in 2026.

Tuesday, he was in court in Bremer County to discuss the evidence that will be admitted into the trial. Frederiksen defense wants the child porn to be excluded, saying it would bias a reasonable juror against their client. The prosecution wants it to be included, because they say it shows that Frederiksen was attracted to children, and could established his state of mind, necessary for a murder conviction.

Chris Callaway, of the Iowa Division of Criminal Investigation, testified about the thousands of child porn images and videos. He said some depicted adult men have sex with children under the age of 11. He also said Frederiksen told investigators he was attracted to Evelyn while changing her diaper.

Linda Christie is Evelyn's grandmother. She was in the courtroom, and wants the jury to know about the images.

She said she wants justice.

"I hope he gets life in prison," she said. "He can rot in prison, and for eternity, he can rot in hell."

Callaway's testimony at the hearing coverage Evelyn's injuries. Much of that was hard to hear for Christie, including the name of the folder on his computer containing the porn.

"!!DadsLittleGirl04," Callaway told prosecutors.

"Did other folders on that zip drive contain similar titles?" he was asked.

"Yes, and some more descriptive than that."

Christie said this info coming to light is karma.

"What goes around come around," she said of Frederiksen.

The judge has not issued his decision on whether jurors will be told about the porn. Frederiksen's trial will be in Hamilton County sometime in February.
