Hit and run survivor takes bar to court after 2011 crash

A woman who lost her leg in a crash is now suing a Cedar Falls bar. She says the business served too much alcohol to the driver that hit her.

Joan Nicholson was riding her motorcycle west of Cedar Falls nearly three years ago when a black truck crossed the centerline and hit her. That driver then left the scene.

Jennifer Moeller was sentenced to five years in jail for the accident, but after serving 30 days, a judge released her on probation.

Nicholson is back at work and doing everything she did before the accident, but a little differently now with a prosthetic leg. She says she remembers the accident clearly and has only a few nightmares now.

This week Nicholson took B.J. Properties, which operates The Pump Haus, to court. She wants nearly $2 million, mostly for her medical costs.

On Tuesday the trial left with a hung jury. Nicholson says she wishes someone would take some blame for some of the things that have happened.

"People think it's all about the money and it's not. You know, I've been dealt such a tough road the last couple years that I just want finally somebody to say, 'hey, yeah we were the cause of some of that' and so it kind of takes away from my what-ifs," said Nicholson.

The case now has been set for another date. Nicholson says she's ready to go to court again if she has to.
