A Black Hawk County judge says the search of a Dunkerton football player's bag that turned up a gun and drugs was legal.
School officials searched Mar'Yo Lindsey's bag on August 30 after the team returned to the school following a game in Riceville and found a gun and marijuana. The bag was left on the bus because Lindsey had been taken to a hospital after being injured.
Lindsey never returned to school and was apprehended in Texas in November and returned to Iowa.
Last week, Judge Kellyann Lekar heard the defense motion to dismiss the evidence found in the bag claiming the search was illegal.
Judge Lekar ruled on Monday afternoon that the search was legal.
The defense agreed on Tuesday afternoon to move forward with a bench trial.
Judge David Staudt now has the case and will make a ruling at a later date.
