3 men serving life for murder get chance at new sentences

MARSHALL COUNTY (KWWL) -

Three men convicted of killing a woman two decades ago will get a chance at new sentence after the Supreme Court made mandatory life sentences illegal for juveniles.

Burt Smith, Derek Smith, and Jayson Speaks were convicted of first-degree murder in the death of Rebecca Hauser. All three were 15 years old at the time of the murder.

According to our records, the three men were accused of using flashing emergency lights to pull over Hauser's vehicle near Liscomb in 1994.

Once the vehicle was stopped, Speaks is accused of telling the Smith brothers to shoot Hauser.

Burt Smith then allegedly shot Hauser in the head and stabbed her more than 30 times.

Derek Smith also allegedly beat her with a rifle.

All three men were in court Thursday to determine who will represent them during the re-sentencing hearing.
