Board charges Cedar Falls optometrist with drug use, negligence

A Cedar Falls optometrist who previously failed to complete a substance abuse evaluation as ordered by a state medical board now faces six new charges by that board.

The Iowa Board of Optometry charged Mark Davis of Cedar Falls with six different charges, most of them related to substance abuse, on April 4. The notice was released to the public last week.

Davis' hearing is scheduled for July 11.

Davis, who most recently practiced at Perry L Krieger, O.D. and Associates in Cedar Falls, faces the following charges:

* habitual intoxication or addiction to the use of drugs;

* obtaining, possessing, attempting to obtain or possess, or administering controlled substances without lawful authority;

* negligence in the practice of the profession, including conduct, practice or conditions which impair the ability to safely and skillfully practice the profession;

*conviction of a crime related to the profession of occupation of the licensee or the conviction of any crime that would affect the licensee's ability to practice within the profession, regardless of whether the judgment of conviction or sentence was deferred;

*failure to comply with the terms of a Board order; and

*representing himself as an optometry practitioner when his license was on inactive status.

The Board alleges that between 2006 and 2013, Davis was convicted of operating while intoxicated three times and charged four times for possession of marijuana.

The Board says he also failed to provide documentation that he completed a Board-ordered substance abuse evaluation in October of 2012.

Davis' license was also inactive since July 31, 2012, but the Board claims he continued to practice at Perry L. Krieger, O.D. and Associates through Feb. 26, 2013.
