DUNKERTON (KWWL) -

The mayor of Dunkerton is scheduled to go on trial Tuesday after motions filed by his attorney to dismiss the case have been rejected by a judge.

Michael Schares and his nephew, Thomas Adamson, face interference with official acts and harassment of a police officer charges.

A police officer says Schares and Adamson interfered when he pulled over Adamson's wife for allegedly speeding in December.

A judge found that none of the powers or authorities of a mayor prevent the state from proceeding with prosecuting case.

Schares' attorney had claimed the mayor was in city's chain of command and was exercising his ability to fire employees.

Associate Judge James Coil says laws apply equally to everyone including mayors who have no special protection.
