Man convicted in 2008 Waterloo shooting to get new trial

A man convicted in a 2008 Waterloo shooting is getting a new trial.

The Iowa Supreme Court say Anthony Devon Polk should get a new trial because a police officer violated his rights to be represented by an attorney during questioning.

Polk, who was 22 at the time of the shooting, received a 10-year sentence for carrying a dangerous weapon and going armed with intent was overturned.

Polk was charged with shooting two men and was promised leniency by a police officer for talking. The officer convinced Polk to discuss the shooting and Polk eventually confessed.

The court says the officer went too far after Polk asked to remain silent and his confession should not have been admitted at trial.
