Charges dismissed against Dubuque businesswoman

Federal prosecutors dismissed charges, on Tuesday, against a Dubuque woman facing prison time for allegedly damaging a wetland while building a campground.

Monday, Elaine Kelly, 65, had asked to withdraw her guilty plea.

 

Kelly had entered a guilty plea last week to one count of violating the Clear Water Act. She was accused of discharging pollutants into a wetland while building the Hoot Owl Hollow campground.

Kelly's family said she is the victim of overzealous federal regulators and pleaded guilty to avoid the possibility of a longer prison term.

 

Prosecutors filed paperwork, Tuesday afternoon, dismissing the charge without prejudice. That meant they could still ask a grand jury to indict Kelly on similar charges.
