Mitchell County will not challenge steel wheel ruling

OSAGE (KWWL) -

Mitchell County won't appeal the Iowa Supreme court ruling against the county's steel wheel ordinance. However, the County Attorney believes the new steel wheel ordinance will be challenged in the future.

Mark Walk says the court ruled on an old ordinance. The steel wheel ordinance has since been changed and Walk believes it will prevail if its ever challenged in court.

Last Friday, the court reversed a 2010 citation against a Mennonite teenager for driving a steel wheel tractor on a county road. Mennonites say steel wheels are a part of their religion. The court ruled the 2010 ordinance violated the First Amendment.

Mitchell County officials argue the wheels damage the roads.
