Court upholds Mark Becker murder conviction


An appeals court has upheld a murder conviction of a man who fatally shot his former football coach.

Mark Becker said he was legally insane when he shot Aplington-Parkersburg High School Coach Ed Thomas in June 2009 in the school's weight room. But a jury found him guilty of murder, rejecting his insanity defense.

Doctors testified at the trial that Becker is a paranoid schizophrenic but they disagreed over whether he knew right from wrong when he shot Thomas.

Lawyers of Mark Becker argued jurors were given incorrect instructions about the legal definition of insane.

On Thursday, The Iowa Court of Appeals ruled the wording of one instruction was incorrect, but say jurors were given another instruction later that correctly defined what is insanity.
