VINTON (KWWL) -

The Benton County Sheriff's Office says the mother of a six month old that was killed in an accident near Keystone in October has been charged.

Nicole Jacobs, 37, is charged with homicide by vehicle, child endangerment causing death, serious injury by vehicle, child endangerment causing bodily injury, child endangerment causing serious injury and first offense operating while intoxicated.

The Benton County Sheriff's Office says that around 2:30 p.m. on Oct. 8, 2010, Jacobs was eastbound in the 1300 block of 68th Street when she lost control of her van.

Jacobs, her six-month-old son Lincoln, four-year-old daughter Kailyn and four-year-old family friend Mackenzie McWhorter, were all thrown from the van as it went into the ditch and rolled over.  Deputies say the van then landed on top of Lincoln, killing him.

The sheriff's office says that Jacob's blood alcohol level was above the legal limit at the time of the accident and all occupants were unrestrained.

Jacobs was arrested in Kanawha by Benton County Sheriff Deputies and taken to the Benton County Jail where she is being held on a $ 25,000.00 cash only bond.
