Defense, prosecution rest in Hilgendorf murder trial


DAVENPORT (KWWL) -- Both the prosecution and the defense rested their cases Friday morning in the Jacob Hilgendorf murder trial.

Hilgendorf is accused of the July 2009 first-degree murder of Curtis Bailey.  Jessica Dayton was accused of the same crime and sentenced in June 2010 to life in prison without parole. Denise Frei, Hilgendorf's mother and Bailey's common law wife, was also involved in Bailey's death and will stand trial after Hilgendorf.

After hearing from the prosecution's final witness, the defense called no witnesses. Hilgendorf declined to testify.

Jurors were excused, and the defense then asked twice for the judge to consider acquitting the case, citing insufficient evidence and a change in the prosecution's strategy since Jessica Dayton's trial. The judge denied both motions.

Closing arguments in the Hilgendorf trial are set for Tuesday morning.
