Arrest made in Cedar Rapids stabbing

CEDAR RAPIDS (KWWL) -- Cedar Rapids Police have arrested a man they say stabbed another man who was trying to protect his mom.

Police were called to 75 Aossey Lane SW, apartment #4, AT 3:13 pm on December 12, 2010 for a report of a stabbing.  When they arrived, they found Cory Bailey, 22, with a cut on his left wrist and a stab wound on the left side of his abdomen.  He was taken to St. Luke's Hospital where he had to undergo surgery.

Through their investigation, police determined that Bailey was in his bedroom when he heard his mom, Selina Brown, yelling for help.  She was in a fight with another woman in the living room of the apartment Brown shared with her son.

When Bailey stepped in to protect his mom, he was stabbed by a man who was with the woman assaulting Bailey's mom. The pair left the apartment after stabbing Bailey.

The Iowa Division of Criminal Investigation completed their investigation and requested a warrant for the arrest of Richard Kearney, 47, for Willful Injury.

On Wednesday, DCI Investigators who were looking for Kearney stopped a vehicle in the 600 block of Center Point Road NE with the help of the Iowa State Patrol to serve the warrant.

Kearney was arrested and taken to the Linn County Jail.

According to police, Kearney is not a stranger to the criminal justice system.  He was arrested in July of 1985 and charged with First Degree Murder in the death of Lloyd C. McIlvain, 41.

Police say Kearney bludgeoned McIlvain to death.

Kearney was convicted of Second Degree Murder and sent to prison. He was paroled on October 1, 2007, but that was revoked on April 28, 2009. He was released from prison on February 19, 2010 after serving his full sentence.
