Waterloo Schools motion to dismiss dress code appeal denied

WATERLOO (KWWL) -- Ricki and Teesha Peters say they will have the chance to appeal  the Waterloo Community School District's original dress code policy that was put in place last May.

The Peters' say Administrative Law Judge Carol Greta ruled Wednesday to deny the school district's motion to dismiss their appeal.

The district has revised the dress code policy to say what students can't wear to school after Judge Greta ruled that telling students what they can wear to school did not meet Iowa Code.

The school board wanted to dismiss the Peters' appeal because it was based on a policy that was no longer in place.

Judge Greta said that it should be heard because larger issues need to be resolved.

"The underlying question here is of considerable interest to the public and to public school officials, and is quite likely to recur," said Judge Greta in a written statement.

The Iowa Board of Education will hear the Peters' appeal on January 27 in Des Moines.
