Mayton sentenced for assaulting Dubuque County Attorney


DUBUQUE (KWWL) -- Michael Mayton received a five year sentence Monday for the class D felony of willful injury against Dubuque County Attorney Ralph Potter.

The assault happened July 9, after Mayton received his 55-year sentence for stabbing two men.

Dubuque County prosecutor Ralph Potter wrote a victim impact statement.  In it, he said he believes the suggested 5-year sentence should be served consecutively, since allowing Mayton to serve it concurrently with his jail time for murder would be like giving him no extra punishment for the assault.

He said a concurrent sentence would send the message to defendants that assaulting an officer of the court wouldn't mean additional punishment.

He said sending that message could put court personnel and law enforcement officials at risk.

The judge said similarly when she told Mayton she'd decided to have him serve his five-year sentence for willful injury -- consecutively, tacking that on to the maximum sentence of 55 years Mayton is already serving for assault and murder.
