Police say Cedar Rapids man drove drunk with kid in his car

CEDAR RAPIDS (KWWL) -- A Cedar Rapids man is facing Child Endangerment charges after police say he was driving drunk with his son in the car.

Robert Jason Banes, 45, was stopped Sunday afternoon in the 4000 block of 42nd Street NE after officers were told of a possible drunk driver.

Officers found Banes' 11-year old son in the car with him.

Banes was arrested and charged with Operating While Intoxicated, Child Endangerment, Reckless Driving and Windshields and Windows.

Sunday was not Banes' first run in with police.  A check of online court records shows that Banes was arrested in January of 2009 and charged with Operating While Intoxicated and two counts of Child Endangerment.  Police say he had his 9 and 10-year old children in the car with him at that time.

Police say Banes has no family around and the kids are now in the custody of DHS.

Court records also show that Banes was charged with Failure to Maintain Control, Driving While License Under Suspension and Operating Without Registration following an incident at Edgewood Road and F Avenue NE in April of this year.
