Denver residents and businesses can sue over flooding


DES MOINES (AP) -- The Iowa Supreme Court has ruled residents and businesses in a northeast Iowa town can sue the state for flood damage caused by a highway project.

The court Friday overturned lower court decisions dismissing the lawsuit filed by residents of Denver whose homes and businesses were damaged during a rainstorm in May 1999.

They claimed a highway project blocked a floodway near a creek and changed the natural flow of water into the community.

A district court dismissed the lawsuit, claiming the state was immune from damages, and the Iowa Court of Appeals agreed.

The Iowa Supreme Court overturned those decisions, saying the state could be held responsible but denied claims for permanent devaluation of property.

Telephone messages left for attorneys in the case were not immediately returned.
