Judge returns guilty plea


DES MOINES COUNTY (KWWL) -- A man accused of breaking a 76-year-old woman's arm as he tried to rob her at a Des Moines county casino has convinced prosecutors to let him out of his guilty plea.

David Mathias insists he was given bad advice by a public defender.

He says he was told he would serve just less than four years for his second degree robbery conviction. The law would have required him to serve 70 percent of a seven year sentence -- almost 5 years.

Tuesday a Des Moines county judge gave him his guilty plea back saying a defendant must fully understand what he's facing before pleading guilty to a crime.
