UPDATE: Oswald allegedly bought student victim's cell phone

DUBUQUE (KWWL) -- The 17-year-old girl who claims she had sex with Hempstead Assistant Principal Shane Oswald says the administrator bought her cell phone because of incriminating text messages.

Oswald is charged with sexual exploitation by a school employee, distributing drugs to a minor, and providing alcohol to a minor.

In court documents, the girl says she lost her pink Samsung cell phone at the end of October or beginning of November.  She told police she heard her ex-boyfriend found the phone and sold it to Oswald for money.  Court documents say Oswald allegedly bought the phone because there were "incriminating text messages from Oswald on the phone".

The same ex-boyfriend is who allegedly told the girl's mother about the sexual relationship between Oswald and the girl. 

On January 27th, Dubuque Police got search warrants for Oswald's home and office.  They were taking photos of the outside and inside of his home and looking for the girl's phone, Oswald's cell phone and prescription drugs.

Police only recovered a black Blackberry phone and Oswald's passport, both inside the home.  Police did not find the girl's phone.

During an interview, the girl drew a diagram of the inside of Oswald's home, including the basement where the two allegedly had sex on several occasions.

On Tuesday, Oswald asked for a bond reduction, stating he could not afford the $50,000 bond.  The judge denied that request.  On Wednesday, his father posted the $50,000, and Oswald was released from the Dubuque County Jail. 

Oswald is on paid administrative leave from the Dubuque Community School District.  Court documents show Oswald makes $84,000 a year as assistant principal.
