Former Agriprocessors supervisor asks for lesser sentence

CEDAR RAPIDS (KWWL) -- A former Agriprocessors supervisor is asking a judge correct his prison sentence for his part in hiring illegal immigrants at the plant.

Juan Carlos Guerrero-Espinoza is serving 36 months in prison. Two years of that is the mandatory sentence for aggravated identity theft.

According to a motion filed Monday, Guerrero-Espinoza wants a judge to correct his sentence based on a recent US Supreme Court decision that changes the requirement for proof for identity theft.

He claims he should only be sentenced to 19 months in prison for the offense.
