Court upholds kidnapping conviction

WATERLOO (AP) -- A Waterloo man has failed to get his life prison sentence for kidnapping and robbery overturned by the Iowa Court of Appeals.

Thomas Deshawn Holmes was convicted of the 1999 beating and raping of a woman left for dead.

Holmes, now 29, asked the appeals court to reverse the verdict, contending his trial attorney failed to argue there was insufficient evidence to support the kidnapping charge.

The appeals court ruled this week rejected the argument, saying there was sufficient evidence to back the kidnapping charge.

According to court records, the woman met Holmes at an after-hours house and they later ended up together in her car. She testified Holmes hit her and forced her to drive to a remote area where he made her disrobe in a ditch and beat her with baseball bat.
