Couple sues over denial of greyhound kennels


DUBUQUE (KWWL) - A lawsuit has been filed against Dubuque County in the wake of a board's decision to deny a couple's request to building greyhound kennels on their property.

In the lawsuit filed in Dubuque District Court, Dan and Sarah Zenner claim the Zoning Board of Adjustment acted in "excess of its authority and illegally" and in violation of the county's zoning code.

The Zenners contend the board acted in a "judicial capacity" by upholding Dubuque County Zoning Administrator Anna O'Shea's decision that greyhound kennels are not a permitted use in A-1 agricultural districts.

Dubuque County's zoning code states kennels are permitted as long as they don't house animals "not normally associated with domestic enjoyment."

The Zenners claim greyhounds fall under the umbrella of domestic animals.
