Man seeks new trial in Charles City bar killing


CHARLES CITY, Iowa (AP) -- A New Hampton man convicted in a fatal stabbing at a Charles City bar wants a new trial, claiming a key state witness lied about his identity.

A Floyd County jury in April found Richard Cortez guilty of second-degree murder in the death of Kenyon Armstrong, of Charles City, in May 2008.

In a motion for a new trial, Cortez claims, among other issues, that a man who identified himself as Cyrus Riley on the witness stand lied about his identity and is actually Barry Holden.

The man identified as Holden allegedly was the first person attacked by Cortez.

Cortez was to be sentenced Tuesday, but that was delayed until July 17, when the court will also take up the motion for a new trial.
