
DUBUQUE (KWWL) -- The Dubuque County Attorney's Office says a grand jury has found that Christopher Leppert was "legally justified" in the shooting of David Herman on November 29, 2008 that resulted in Herman's death.
The Dubuque County Sheriff's Office says that the incident started as a verbal disturbance outside the Bonjour Apartments in Dyersville.
Police say during the argument, Leppert, a maintenance man at the apartments, shot Herman, a tenant.
Herman was taken to Mercy Hospital in Dyersville where he was pronounced dead.
The grand jury found the shooting justified because Leppert was either defending himself from injury or preventing a felony from occurring.
Ballistics test showed that Leppert and Herman were only a foot apart when the shots were fired.
Herman would have been committing First Degree Burglary, a felony, if he had been trying to enter Leppert's vehicle while Leppert was inside.
